Agreement and provider
These terms form an agreement between you and Benjamin Melki, Entrepreneur individuel (EI), Paris, France (“we”, “us” or “our”). They govern your access to and use of the Plastic Surgery Simulator desktop software, website, customer portal, free trial and paid licence. By installing, activating, purchasing or using the software, you agree to these terms. If you do not agree, do not use the software.
Plastic surgery results are not guaranteed
A simulation is only an illustration. It is not a prediction, promise or guarantee of the result of any plastic surgery procedure. Actual outcomes can differ substantially because of anatomy, surgical technique, healing, complications and other factors that the software cannot assess. The software does not provide medical advice, diagnosis or a treatment plan and does not replace an in-person assessment by a suitably qualified and licensed healthcare professional.
Licence granted
While your trial or paid subscription is valid and you comply with these terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use Plastic Surgery Simulator for your own professional or personal work. One paid activation key covers one platform only—Windows or macOS—and may be active on up to two of your own computers. It is not a concurrent multi-user or shared-practice licence. Separate licences are required for another user or another platform.
We and our licensors retain all ownership and intellectual-property rights in the software, website, documentation, branding and underlying technology. The licence gives you a right to use the software; it does not transfer ownership.
Free trial
The free trial provides the complete software for seven days from activation, requires no payment details and expires automatically. It is limited to one trial per eligible computer. You may not circumvent or attempt to reset the trial limit. A trial does not create a paid subscription and will not be charged automatically.
Purchase, term and automatic renewal
At the date of these terms, a licence costs US $99 for twelve months. The price, currency, applicable taxes and selected platform shown at checkout are the controlling order details. Payment is processed by Stripe. We do not receive or store your complete card or bank details.
Your subscription renews automatically for another twelve-month term at the then-applicable price unless you cancel renewal before the renewal date. You can manage payment methods, invoices and cancellation through the Stripe Billing Portal linked from your customer account. If you cancel renewal, access continues through the period already paid for and then ends. A terminally cancelled subscription cannot be resumed; a later purchase creates a new licence and activation key.
Your activation key remains permanently available in your customer account. You are responsible for keeping access to your email account, customer account and activation key secure and for notifying us promptly if you suspect unauthorized use.
Activation, licence checks and updates
An internet connection is required to start a trial, activate a paid licence and periodically refresh licence status. The software may continue working offline for a limited period after a successful check, but uninterrupted offline access is not promised. Access may end when a trial or paid period expires, payment remains unpaid, a refund fully revokes the licence, a device is released or revoked, or these terms are materially breached.
The Microsoft Store is the Windows download, installation and update channel; it does not sell or control the PSS subscription. Updates, changes and fixes may be released during your subscription. We do not promise that every feature will remain unchanged or that the software will remain compatible with unsupported hardware, operating systems or third-party services.
30-day refund policy
Plastic Surgery Simulator includes a complete seven-day free trial, with no payment details required. You are strongly encouraged to install and test the trial on the computer and workflow you intend to use before you buy.
You may request a refund within 30 days of the purchase date by emailing contact@plastic-surgery-simulator.com from the address associated with the purchase. We may ask for enough information to locate and verify the transaction. A full refund permanently ends the associated licence and activation key.
This voluntary refund policy does not limit any non-waivable statutory cancellation, conformity, warranty or refund rights that apply to you. A chargeback or payment dispute does not itself create additional licence rights.
Your images, storage and lawful use
You are solely responsible for the images and other content you open, create, save, print or share; for where they are stored; and for their security, backup, retention and deletion. Plastic Surgery Simulator processes images locally and does not provide cloud storage, synchronization, backup, recovery, patient-record management or access control for them.
You must have all rights, permissions, consents and other lawful bases required to use each image, especially where it identifies a patient or contains health-related information. You are responsible for professional confidentiality, informed consent, access permissions, device security, backup practices, retention schedules, disclosures, and compliance with laws and professional duties that apply to your practice. If you choose a cloud-synced or network folder, or use Windows sharing, printing or another third-party service, that choice and the resulting transfer are governed by your configuration and the third party’s terms and privacy practices, not by us.
Restrictions
You must not share, sell, rent, sublicense, publish or transfer an activation key or the software; make the software available as a shared service; bypass activation, trial, subscription, device or security controls; copy or distribute the software except for lawful backup; remove ownership notices; use it unlawfully or to violate another person’s rights; or reverse engineer, decompile or disassemble it except to the limited extent that applicable law expressly permits despite this restriction.
Software availability and support
We use reasonable care in providing the software, licensing service and support, but no software is error-free. To the extent permitted by law, we do not guarantee uninterrupted availability, compatibility with every computer or third-party service, or that the software will meet every individual requirement. You are responsible for testing the trial on the computer and workflow you intend to use and for maintaining independent backups and a suitable business-continuity plan.
Nothing in these terms excludes any mandatory legal guarantee or remedy, including rights that consumers may have for digital content or services.
Liability
To the maximum extent permitted by applicable law, we are not liable for an actual surgical outcome or clinical decision; loss, corruption or unauthorized disclosure of images or other content under your control; your choice of storage, backup, sharing or cloud provider; or indirect, incidental, special or consequential losses, including lost profits, revenue, business or professional opportunity.
Where liability may lawfully be limited, our aggregate liability arising from the software or these terms is limited to the amount you paid us for the affected licence during the twelve months before the event giving rise to the claim. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence where applicable, death or personal injury caused by negligence, or non-waivable consumer and data-protection obligations.
Suspension and termination
You may stop using the software at any time. Cancelling automatic renewal affects future billing but does not normally refund or shorten the period already paid for. We may suspend or terminate access when reasonably necessary to address fraud, unlawful use, shared or compromised keys, payment failure, security risk, a material breach of these terms, or a legal requirement. Where practical and lawful, we will give notice and an opportunity to correct a remediable breach.
Termination ends the licence to use the software. It does not delete ordinary image files you previously saved on your own devices, and it does not remove obligations or rights that by their nature survive termination.
Governing law and disputes
These terms are governed by French law. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of residence, and any dispute may be brought before the courts competent under applicable consumer law. Before starting formal proceedings, please contact us so that we can try to resolve the matter.
Changes, severability and contact
We may update these terms to reflect changes in the product, law or business. The date above identifies the current version. Material changes will apply prospectively and will be communicated when required by law. If one provision is found unenforceable, the remainder continues to apply to the extent permitted by law. A failure to enforce a provision immediately is not a waiver.
